This module will examine Constitutional Law aspects to marriage, the family and members thereof. The module essentially involves an examination of marriage validity and the legal remedies available upon marriage breakdown. It will involve an in-depth examination of marriage validity, nullity proceedings and bars to relief. A detailed examination of judicial separation, divorce, legal separation and recognition of foreign divorces will be given. There will also be an extensive assessment of the reliefs available upon judicial separation, divorce and foreign divorce. The module has a predominantly domestic perspective but comparative elements are examined where relevant. There is also an EU perspective to the course owing to recent EU directives.
